Welcome to Kaze Cloud. By using our services (including VPS, VDS, and dedicated server rentals), you agree to the following Terms of Service (the "Terms"). These Terms constitute a binding agreement between you (the "Customer") and Kaze Cloud ("we," "us," or "our"). If you do not agree to any part of these Terms, you must immediately cease using our services.

Definitions

1. Customer: Any individual or entity that purchases or uses Kaze Cloud services.
2. Services: Includes all VPS, VDS, and dedicated server rental services provided by Kaze Cloud.
3. User Content: Any data, files, software, or other materials stored, transmitted, or processed by the Customer through our services.
4. Prohibited Activities: Any use of our services that violates these Terms, including but not limited to illegal, abusive, or harmful activities.

Acceptable Use Policy

1. Legal Compliance: Customers must use our services in compliance with all applicable local, national, and international laws. Prohibited activities include, but are not limited to:

   1. Hosting or distributing illegal content, including but not limited to child pornography, copyright-infringing material, or content promoting violence, hate, or terrorism.
   2. Engaging in phishing attacks, scams, or fraudulent activities.
   3. Conducting unauthorized penetration testing, hacking, or distributing malware.
   4. Participating in or facilitating DDoS attacks, spam campaigns, or any other disruptive activities.

2. Prohibited Content: Customers are strictly prohibited from using Kaze Cloud services to host, store, or distribute:

   1. Material that violates intellectual property rights or applicable copyright laws.
   2. Content that promotes illegal activities, such as drug trafficking or financial fraud.
   3. Content that violates the laws of Hong Kong or any other relevant jurisdiction.

3. Resource Usage: Customers must not exceed the allocated resources for their plan or engage in activity that disrupts or degrades the performance of Kaze Cloud's systems or other Customers' services. We reserve the right to limit, suspend, or terminate accounts that excessively consume resources or negatively impact our infrastructure.

4. Monitoring: Kaze Cloud reserves the right to monitor network traffic and server usage to identify violations of these Terms. Any flagged activity may result in immediate service suspension or termination.

Account Security and Customer Responsibilities

1. Account Security: Customers are solely responsible for maintaining the confidentiality of their account credentials. Any unauthorized access or misuse of your account due to negligence or weak security measures is your responsibility.
2. System Security: Customers are required to secure their servers and ensure that software installed on their servers is updated and free from vulnerabilities. Failure to do so may result in service suspension.
3. Unauthorized Access: Customers must not attempt to access, interfere with, or disrupt other servers, accounts, or systems within Kaze Cloud's infrastructure. Violators will be subject to immediate termination and potential legal action.

Payment and Billing Policy

1. Payment Terms: Customers must pay all invoices on or before their due date. Failure to pay may result in service suspension or termination.
2. Refunds:
   1. First-time Customers: Refunds may be issued for first-time purchases within 24 hours of service activation, provided the Customer has not violated these Terms or used the service for prohibited activities.
   2. Non-Refundable Situations: Refunds will not be issued for early termination of contracts, misuse of services, or violations of these Terms.
3. Currency and Taxes: All payments are processed in US Dollars (USD). Customers are responsible for all applicable taxes, fees, or transaction charges.

Limitation of Liability

1. No Guarantees: While Kaze Cloud aims to provide reliable service, we do not guarantee uninterrupted or error-free operation. Services are provided "as is" and "as available."
2. Data Loss: Kaze Cloud is not liable for any data loss, corruption, or unauthorized access to Customer Content. Customers must maintain their own backups of critical data.
3. Third-Party Actions: Kaze Cloud is not responsible for damages caused by third parties, including but not limited to cyberattacks, unauthorized access, or actions of other Customers.
4. Maximum Liability: In all cases, Kaze Cloud's total liability is limited to the amount paid by the Customer for the service in the preceding one (1) month.

Service Suspension and Termination

1. Suspension and Termination for Cause: Kaze Cloud reserves the right to suspend or terminate services immediately if:
   1. The Customer violates any provision of these Terms.
   2. The Customer engages in prohibited activities or misuses the services.
   3. The Customer fails to pay invoices on time.
   4. Kaze Cloud suspects, at its sole discretion, that the Customer's activities may harm Kaze Cloud, its partners, or other customers.
2. Termination by Customer: Customers may terminate their services at any time by notifying Kaze Cloud in writing. However, any prepaid fees are non-refundable unless otherwise specified in these Terms.
3. Preservation of Rights: Kaze Cloud reserves the right to pursue legal action for damages resulting from violations of these Terms.

Indemnification

The Customer agrees to indemnify, defend, and hold harmless Kaze Cloud, its affiliates, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

1. Customer's misuse of the services.
2. Violation of these Terms by the Customer.
3. Any disputes or claims related to Customer Content.

Modifications to the Terms

1. Kaze Cloud reserves the right to update or modify these Terms at any time. Updates will be posted on our official website and will take effect immediately upon publication. Continued use of our services after the Terms have been updated constitutes acceptance of the revised Terms.

Governing Law and Dispute Resolution

1. These Terms shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts of Hong Kong.
